Expert testimony standard in California
Kelly/Frye general acceptance applies to new scientific techniques, but Sargon makes the trial judge a gatekeeper of expert reasoning under Evid. Code §§801–802: an opinion resting on speculation or an analytical gap can be excluded even when the method is conventional.
General acceptance governs novel scientific methods. Established field methods — refrigerant-circuit diagnosis, airflow and static-pressure measurement, code and submittal review — are not novel, so challenges usually move to qualifications and factual foundation. The record still has to be clean enough to carry the opinion without help.
Federal courts in California
Federal courts apply Federal Rule of Evidence 702, amended December 1, 2023 to make explicit that the proponent must show each admissibility requirement is more likely than not met — including that the opinion reflects a reliable application of the method to the facts. Retained experts produce a written report under Rule 26(a)(2)(B).
Forum matters here. In a diversity case filed in or removed to federal court, California substantive law governs the claim — including its repose period — but Federal Rule 702 governs whether the expert testifies. The same opinion can face California’s Frye test in state court and full Daubert gatekeeping across the street. We write reports to the stricter standard by default.
Construction claim deadlines in California
- Complaints against licensed architects, engineers, and land surveyors require a certificate of merit after consultation with a licensed professional (CCP §411.35).
Repose usually runs from substantial completion, so commissioning records, certificates of occupancy, and startup reports are often the first documents we ask for — they fix the clock and the as-built condition at the same time.
Expert disclosure in California practice
California uses a simultaneous expert-witness exchange with an attorney declaration (CCP §2034.210 et seq.) rather than a federal-style written report — so the deposition is where the opinion is tested, and the field record has to carry it.
Who sets the contractor standard in California
Contractors are licensed by the CSLB (C-20 HVAC; C-38 Refrigeration). The California Mechanical Code (Title 24, Part 4) is based on the UMC, not the IMC — a frequent source of out-of-state expert error.
We measure work against the code edition in force at permit, the manufacturer’s installation and maintenance requirements, and what a reasonable, qualified contractor would have done in California. Where a question turns on engineering judgment, or a California statute requires an affidavit from a licensed design professional, we engage a Professional Engineer licensed in California. We do not perform repairs on matters we investigate.
