How we work outside Florida

Qualified by the court

Expert qualification turns on knowledge, skill, experience, training, and education under the forum’s evidence rule. Our opinions stay inside contractor expertise: installation, workmanship, maintenance, refrigerant handling, and code compliance.

Local PE where required

Engineering-judgment questions and certificate-of-merit affidavits — Texas ch. 150, New Jersey, Pennsylvania, Georgia, and others — go to a Professional Engineer licensed in the project state.

Measured against local rules

The benchmark is the code edition adopted where the work was permitted, the state’s contractor licensing rules, and the manufacturer’s requirements — never Florida rules exported.

Quick answers

Counsel FAQ

Do you provide HVAC expert witness services outside Florida?
Yes. We take forensic investigation and expert witness engagements in federal and state courts in all 50 states, the District of Columbia, and the U.S. territories. Courts qualify experts by knowledge, skill, experience, training, or education rather than in-state contractor licensure. Where a matter requires engineering judgment or a state statute requires an affidavit from a licensed design professional, we engage a Professional Engineer licensed in that state.
Which states use Frye instead of Daubert?
As of 2026-10-01, California (Kelly/Frye with Sargon gatekeeping), Illinois, Minnesota (Frye-Mack), New York, Pennsylvania, and Washington apply Frye-based tests. Most other states apply Daubert or a Daubert-type standard; a handful — including Maine, Nevada, North Dakota, South Carolina, Utah, and Virginia — apply their own reliability tests. All federal courts apply Federal Rule of Evidence 702 and Daubert.
How is a nationwide forensic engagement staffed?
Daniel E. Reyes leads the investigation and gives contractor-side opinions on installation, workmanship, maintenance, refrigerant handling, and code compliance. A Professional Engineer licensed in the project state is engaged for engineering-judgment questions and certificate-of-merit affidavits. Site inspections are scheduled around preservation needs; data exports and evidence chain of custody are documented from the first visit.
