HVAC expert witness in Pennsylvania

Pennsylvania state courts apply a Frye standard for expert testimony (Pa.R.E. 702(c)). Federal matters are heard in the E.D. Pa., M.D. Pa., W.D. Pa. (appeals to the 3rd Circuit), under Federal Rule of Evidence 702 as amended in 2023. Construction-claim timing: 12 years from completion, extendable to 14 (42 Pa.C.S. §5536).

Section 01 · Admissibility

Expert testimony standard in Pennsylvania

Pa.R.E. 702(c); Grady v. Frito-Lay, 839 A.2d 1038 (Pa. 2003); Walsh v. BASF Corp., 234 A.3d 446 (Pa. 2020)

Pennsylvania writes general acceptance into Rule 702(c) itself; Walsh (2020) reaffirmed Frye and limits the trial court to assessing methodology, not conclusions.

General acceptance governs novel scientific methods. Established field methods — refrigerant-circuit diagnosis, airflow and static-pressure measurement, code and submittal review — are not novel, so challenges usually move to qualifications and factual foundation. The record still has to be clean enough to carry the opinion without help.

Section 02 · Federal courts

Federal courts in Pennsylvania

E.D. Pa. · M.D. Pa. · W.D. Pa. → 3rd Circuit

Federal courts apply Federal Rule of Evidence 702, amended December 1, 2023 to make explicit that the proponent must show each admissibility requirement is more likely than not met — including that the opinion reflects a reliable application of the method to the facts. Retained experts produce a written report under Rule 26(a)(2)(B).

Forum matters here. In a diversity case filed in or removed to federal court, Pennsylvania substantive law governs the claim — including its repose period — but Federal Rule 702 governs whether the expert testifies. The same opinion can face Pennsylvania’s Frye test in state court and full Daubert gatekeeping across the street. We write reports to the stricter standard by default.

Section 03 · Timing & pre-suit

Construction claim deadlines in Pennsylvania

Repose: 12 years from completion, extendable to 14 (42 Pa.C.S. §5536).
  • Professional-liability claims against licensed professionals, including architects and engineers, require a certificate of merit (Pa.R.C.P. 1042.3).

Repose usually runs from substantial completion, so commissioning records, certificates of occupancy, and startup reports are often the first documents we ask for — they fix the clock and the as-built condition at the same time.

Section 04 · Discovery

Expert disclosure in Pennsylvania practice

Expert discovery proceeds by interrogatory and report under Pa.R.C.P. 4003.5; further discovery requires a court order, and trial testimony is generally confined to the fair scope of the report.

Section 05 · Standard of care

Who sets the contractor standard in Pennsylvania

Pennsylvania has no statewide HVAC contractor license; licensing is local (Philadelphia, Pittsburgh), and the Uniform Construction Code adopts the IMC.

We measure work against the code edition in force at permit, the manufacturer’s installation and maintenance requirements, and what a reasonable, qualified contractor would have done in Pennsylvania. Where a question turns on engineering judgment, or a Pennsylvania statute requires an affidavit from a licensed design professional, we engage a Professional Engineer licensed in Pennsylvania. We do not perform repairs on matters we investigate.

Quick answers

Counsel FAQ

Is Pennsylvania a Daubert or Frye jurisdiction?
Pennsylvania applies a Frye standard (Pa.R.E. 702(c); Grady v. Frito-Lay, 839 A.2d 1038 (Pa. 2003); Walsh v. BASF Corp., 234 A.3d 446 (Pa. 2020)). Pennsylvania writes general acceptance into Rule 702(c) itself; Walsh (2020) reaffirmed Frye and limits the trial court to assessing methodology, not conclusions. Federal courts in Pennsylvania apply Federal Rule of Evidence 702 and Daubert.
What is the statute of repose for construction defect claims in Pennsylvania?
12 years from completion, extendable to 14 (42 Pa.C.S. §5536). Repose periods carry exceptions and extensions, so counsel should confirm the period for the specific claim and defendant.
Can an out-of-state HVAC contractor testify as an expert in Pennsylvania?
Generally, yes. Courts qualify experts by knowledge, skill, experience, training, or education under their evidence rule rather than by in-state contractor licensure. Our opinions address installation, workmanship, maintenance, refrigerant handling, and the contractor standard of care measured against the codes and licensing rules that apply in Pennsylvania. Where a question requires engineering judgment, or a Pennsylvania statute requires an affidavit from a licensed design professional, we engage a Professional Engineer licensed in Pennsylvania.
